BOARD CERTIFICATION
The purpose of Florida Board Certification standards in intellectual property is to identify those lawyers who practice intellectual property law and have the special knowledge, skills, and proficiency, as well as the character, ethics, and reputation for professionalism, to be properly identified to the public as certified intellectual property lawyers.
According to the Florida Bar regulating attorneys, Board Certification is designed to provide “an objective measure that a potential client can rely upon when selecting a lawyer.”
To become Board Certified in intellectual property law certification, Florida Bar Rule 6-26.3 requires a lawyer to fulfill the following obligations:
- Practice of law for at least 5 years;
- Experience in one or more of the 4 areas of intellectual property law: patent prosecution, patent infringement litigation, trademark law or copyright law, in the 5 years immediately preceding application;
- Substantial involvement in the specialty of intellectual property law- 30% or more in the 3 years immediately preceding application;
- 45 hours of approved intellectual property law certification continuing legal education in the 3 years immediately preceding application;
- Peer review;
- A written examination.
